These Terms of Service ("Terms") govern Your use of the Sitenotes mobile application, web application and related services (the "Service") provided by Sitenotes Inc, 20118 Cypresswood Estates Run, Spring, TX 77373 ("Sitenotes", "We", "Us" or "Our"). By creating an account or using the Service You agree to these Terms and to our Privacy Policy.

Access to the Service is provided to employees and contractors of Sitenotes customer organizations, such as public agencies, municipalities and engineering firms, who are invited to specific construction projects by a project administrator. You are responsible for keeping Your login credentials confidential and for all activity under Your account. You agree to use the Service only for its intended purpose of documenting and managing construction projects, and not to interfere with, reverse engineer or misuse the Service.

Content You upload to the Service, such as reports, photos and test results, remains the property of You or Your customer organization. You grant Sitenotes the rights necessary to store, process and display that content in order to provide the Service.

Program description. Sitenotes sends transactional text messages (SMS) to registered users about the projects they are assigned to. Examples include daily report approvals and rejections, submittal and RFI reviews, change order approvals, material test requests and lab report uploads, and account invitations. We do not send marketing or promotional text messages through this program.

Opt in. You opt in to receive these messages when You enter Your own mobile number on the Sitenotes sign-in screen (mobile app or https://web.sitenotesapp.com), which displays the SMS disclosure with links to these Terms and our Privacy Policy, and You confirm ownership of the number by entering the one-time passcode we text You. Consent to receive text messages is not a condition of purchasing any goods or services.

Message frequency. The number of messages You receive depends on activity on Your projects and may vary from day to day.

Message and data rates may apply. Contact Your wireless carrier for details about Your plan. Carriers are not liable for delayed or undelivered messages.

Opt out. Reply STOP to any Sitenotes text message to cancel. You will receive one confirmation message and no further texts. You may also ask Your project administrator to remove Your mobile number from the Service. Reply START to resubscribe.

Help. Reply HELP to any message or email support@sitenotesapp.com for assistance.

Privacy. Mobile phone numbers and text messaging opt-in data and consent will not be shared with or sold to third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for how We handle Your information.

The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Sitenotes is not liable for any indirect, incidental, special or consequential damages arising from Your use of, or inability to use, the Service, including delayed or undelivered notifications.

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last Updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
